    My husband has a child who he hasn't seen in years.
    My husband has a child who he hasn't seen in years. Before he and his ex split, she was caught cheating on him with his brother. She had told him that if he left, he would never see his child again. She's held true to that. They spoke about 2 years ago, and she agreed that my husband needed to be part of the child's life, so they exchanged phone numbers, and my husband was told to call her the next day to set up a meeting with the child. When he did this, she screamed at him, and said not to ever contact her again, and to forget ever seeing his son. He has given her money (when he has seen her), but she has never demanded anything from him. A day or two ago, we heard that her new husband had adopted the son. My husband would never sign away his rights! She had gotten pregnant 1 time before during a separation from my current husband, and sent him papers to his mothers address to take a paternity to prove the child was not his. My guess is for child support from her father. So, she can't say that she has no way to contact him. We still have that letter as a matter of fact. I guess my question is, can she legally get this done without his signature? And is there a way to do it by running an ad in the local newspaper? Please help me! Veronica

    She neds his signature or a Court Order to adopt without his signature.

    Her past history does not enter into this. He has a limited time to protest the adoption so he must go to THAT Court and file a Motion.

    Yes, with Court approval a legal ad can be run in legally-recognized newpapers after all other means of notification are exhausted and it is binding legal service.

    Any ideas on the time frame that my husband has? We learned of this the other day, and supposidly it was seen in the local newspaper a year or better ago.

    Depends on the State - if he wants his rights restored, time or not, he HAS to file to get them restored. Maybe he'll win, maybe he'll lose but he'll know he tried. And so will his child.
