    Hi, I come to the UK in 2004 and I claim asylum on my arrival then I was called for an interview on September 2006 then I was refused on Feb 2007 then I went to court in April by May 2007 I was refused in the court. I come from Eritrea I have two kids who were born in the UK my partner and me were married in Church. And my partner is a british citzen as of my kids too. I was wondering my asylum case was refused and I was told I have a chance of applying for a fresh claim. But my question is does the home office treat my case as a Family Legacy if so what do I have to do to find out whether it is Legacy case or not.

    When you apply for immigrant visa under asylum, your case should be handled by experienced immigration attorney... and now your case has been denied, you need to consult your attorney on what your next move should be... don't waste your time.

    The children born in UK do not automatically obtain British citizenship.. so this won't help.
