I'd think most states have something about not just generally "mental health" but incompetence. Certainly not a do-it-yourself venture, or an inexpensive one either: You'd need a good attorney - and the ability to prove it.
What's your situation?

If I understand your question, you are asking whether you can get out of a contract because one party has mental health issues.
In my view, there isn't a yes or no answer to your question. It depends. That said, it's going to be an uphill, and very expensive battle for anyone to win a claim based upon those grounds.
Right now, as we type, a jury is deciding (for the second time) whether a lady who drowned her 5 children in the bathtub, is insane. Lots of people don't think she is. If they don't think SHE'S insane, what chance do you have of proving YOUR case?
I think a negotiated way out of the contract is a better course of action than a "sue me" way out.
