    Can I file us as residents of NY?
    My husband is Army and from March 06 to April 08 we lived in NY. We are still being taxed by the state of NY. I was wondering if when filing from state taxes can I put us in as residents, or do I have to enter us in as non or part-time residents? Would it be illegal to claim as residents?

    Still? In 2009? If yes, then when you file your 2009 tax return, you will ask for refund of NY taxes (if you have left NY permanently).

    How you get taxed by the state depends on which state your husband claims as legal domicile with the Army and whether you worked in 2009 while living in NY.
