I believe it would depend upon the state you live in, as far as the legal age of consent.

In most places that I know of in the U.S. if this is concerning the U.S. it's okay to date, just not to get involved in any sort of sexual way that might break the law where the couple are located, so it would help to know the location about which you're inquiring.

The age of consent in New Jersey is 16. So dating would be okay but something as simple as kissing or touching can get her trouble.

If that's the case we can't control who we like and with your age difference your might be in different places in your life. She might be going to college and your in high school. If your thinking of asking her out don't be mad if the outcome isn't what you wanted.
