If there is nothing in place through the courts regarding custody, then your boyfriend is free to take your son anywhere he chooses. If you really think he would leave, you need to file for custody immediately.

Is the ex boyfriend on the birth certificate ? If yes, then he will have all the same legal rights until there is a custody order in place.

If he is not on the birth certificate is there a custody order in place giving him any rights such as visits.

He can of course always file for custody, but will have to prove you are not a fit mother.

My son's daughter is 2 1/2 years old & her parents have never been married. They have always had shared parenting. We as the grandparents have always taken care of her when my son had her because of his work schedule since he resides with us. This past weekend her mother texted us & said that because she heard that our son was taking drugs, which is unsubstantiated, we could only have her every other weekend because she feared for her daughter's safety. My husband & I are devastated, can we do anything?

Please do not start a new question on an old thread, even if you think the situation is similar. It's best to start a new thread.

You can assist your son in filing for specific custody rights. Without a court order, whichever parent has custody can keep custody and she can take the children from you whenever she pleases.

In some jurisdictions, there is provision for grandparent visitation. But such provisions are generally subject to the primary custody of the parents. So your best bet is to see to it that your son acquires specific custodial rights.
