    Divorce and pregnant with another mans baby
    I was just wondering if in the state of fla if you were in the middle of a divorce and having a baby with a nother guy is it OK to put the other guys name on the birth certificate or do you have to wait till divorce is finalized?

    Depends on your state law. In some states, if you become pregnant before the divorce, it is assumed that your soon-to-be ex is the parent.

    In MA there was paperwork for both the husband and father to sign. It was called an acknowledgment of paternity. I would venture to guess that it is the same in Florida.

    However, we have come to find that the laws in Florida are significantly more flexible than in MA. I'd ask the clerk at your local court or even at the hospital.

    If, for some reason, you cannot, when your child is born your boyfriend goes to court and files for paternity. A DNA test will be performed and the birth certificate will be amended.

    There might be some paperwork and a few headaches, but in the end, if your boyfriend is the child's father, it is going to be a slam dunk, assuming your husband doesn't want to claim the child as his own and become legally responsible for him/her for the next 20 or so years.

    Maybe request a paternity test at the hospital depending on your state laws.

    And part of the divorce filing normally has to state if you are now pregnant or not

    Hi I am going through the same thing now where I live they made me take a test to see if my husband is the father before they give me my divorce and after that I can put the baby's father on her birth certificate.
