    Signing over parental rights to grandmother
    We are in the State of Texas so those laws would apply.

    The father of the children lives with them in his house. The mother is now his roommate since they broke up a year ago. She has been having a relationship with another man and is currently pregnant with his child.

    The mother will be moving away to marry a different man entirely and has said that she will sign over her parental rights to her mother (grandmother to the children). Is this legal? Shouldn't the father retain total parental rights?

    Also, how does the assignation of parental rights work?

    If the father wants the child then he has first rights.
    If he is willing to sign the child to the grandmother then it can be done.

    Custody goes to the father first. Mother can eliminated the father's rights.

    Both parents could agree to give the grandmother guardianship through the Courts OR they could consent to the adoption of the child by the grandmother.
