    Consent and final judment
    Recently my ex-girlfriend sighned a Consent Final Judgment of Paternity Custody,Support and Visitaion papers that I had my lawyer make.The qustion I have is now that she has sighned it she is starting to regret and might try to fight it,could she get custody even if she has sighned this paper.:confused:

    Best advice, you have an attorney talk to him.

    In custody matters, child support and the such, there is no such thing as final written in stone court order.

    I lost custody award twice, with my smaller children, then finally got them back on a temp court order, won the permanent order, then lost custody of them again on another filing about 1 year latter.

    We were back to court at least once and normally 2 or 3 times a year for 12 years. And if she had not died most likely for some more years.

    I have talk to him and he assures me that now that papers are sighned I have a 90% chance of wining custody.But after reading your statement I no longer feel confident about the situation. :(

    I do hope you do win,

    I will be honest, my attorneys always told me I should always win, sadly often attorneys say this so you will pay them and they can go to court.
    And of course the other sides attorney is telling them that they have a good chance to win.

    And let us say that you win because the other person is a drunk, or sleeps around, or a drug user,
    So next in about 4 or 5 years if they correct the problem they will come back and try to refile for custody.

    I had one case, my ex was sleeping with men for money, we had proof, and she did not even deny it in court. She lived in an old dirty mobile home in a XXX part of town, We got photos of the inside of the trailer with trash bags everywhere, and beer cans sitting all around.

    Next we had it timed how many hours the small children were left home alone. With the older of the boyes cooking ( he was about 8) and watching about 3 other smaller children.

    Will all of that evidence, I still lost,

    Im sorry to hear all the trouble you have went through.Hopefully I will not have to go through the samething.For now she is only working part time and can not afford 2 children,the other is a boy of hers from a previous.I already have my daughter enrolled in a highly rated private school so hopefully the court will take that into consideration,also if I lose custody she will be living in government housing if she goes to the mother.With me she will not have to live in government housing.

    Well her mother is telling her that if she lets me have custody that she will disown her,and also telling her to claim duress the reason she sighned the contract.I was wondering if she can claim duress when she sighned it at a bank and the notary could tell she wasn't threatened in any way.
