I live in Florida I have 3 minor children. In brief, I had a domestic violence injunction upheld by the court reversed because she said she was going to get counseling and she wanted to reconcile. During the separation of the domestic violence injunction we each got separate homes to lease in our own names. We discussed moving back in together and we chose the home she had leased. After I had moved the children's things (they were ordered to be with me during the domestic violence injunction with her having supervised visitation) into her home, she told me she doesn't want me to move in yet. I am worried for our children and need to be there for them. Do I have to have her permission to move in? Can she keep me out of the home?

If she has the lease, then you can be removed; and you do need her permission to move into her home. Sounds as though you need legal and relationship advice (couseling).

Do you really want to live somewhere that you aren't wanted? I can think of some awfully evil ways to convince someone they are not wanted somewhere. Do you really want to put yourself through that? I understand that its for the kids... but getting ALL of you involved in a potentially unpleasant situation is not going to help anyone.

To answer your question: no - you cannot move in there without her permission. On the flip side though, does she have custody of the kids now or are you still the custodial parent? Its entirely possible that she just wanted the kids back and used your desire to get back together as a means to an end.

Why did you release the children to her ? At this point she could file against you and also file for full custody. You need to get into court fast and end this relationship. Get a lawyer now.

You needed to keep the children, you may want to keep get them back with you.

Sounds like she tricked you into letter her get the children back
