    Tenants rights
    My landlord refuses to replace anything-carpet is 40 years old or more,heater is 50 or more.I have a wall type space heater that only forces heat towards door and other side is bathroom.There is no heat in the bedrooms . Because it's an older apartment.There isn't any register vents.He thinks I should get heat from downstairs-I tell him not if there isn't any duct work or ventsAm I entitled to get this place up to date?Newer heating system?

    Hi, linda_c!

    Around where I live, all of the apartment buildings and homes are subject to inspection on a regular basis by city inspectors. If there's something that's not up to code, than the apartment owner needs to have it brought up to code.

    If you have people who inspect apartments where you live, then you might want to complain to them.

    And in the end, you have the option of moving if it is not as nice as you need.

    You aren't entitled to anything other than what your state landlord/tenant law AND your rental agreement provides for. There is NOTHING in THAT law, no matter which state you live in, that entitles a tenant to anything that's "up to date".

    Your local zoning law, as Clough suggests, might require the LANDLORD to bring his building into compliance. But, if you're the one who complained about it, he's going to bring it into compliance for the NEXT tenant, because he's going to throw you out when your lease expires. If you don't have a lease, he can throw you out with 30 days written notice.
