    Child Abandonment in Georgia
What papers can a layman file, and what county do you file in? The father has not paid child support for 60+ days. He lives in Georgia, but in a differen t county than where the mother and child live.

If there is a Court Order that he pay support, the mother has to go back to that Court and file to have the order enforced (hold him in contempt).

    Is that your question?

Good luck - glad you got your answer in such a short period. Doesn't always work that way - :)

This is not abondoment, this is merely not paying his child support

You file a motion to bring him back to court

Are you in Georgia? My interpretation/understanding of the state statute was no payment after 30 days constituted child abandonment. It has now been more than 60 days.
Please advise. Also, his county's court or the mother's?

Yes, but it is still done though famiy court and you have to go back there.

They will not do anything for just 30 days late. This merely allows them to put them in jail if they get too far behind. Normally the judge will warn them, give them a few chances before that ever happens.

GA has a good child support enforcement department, they should be handing this. Also GA normally allows for garnishment of the paycheck very easy.

Only the Court can make the determination that it's child abandonment - and they seldom do. What would the purpose of getting a declaration that the child was abandoned?

As far as which Court: "the mother has to go back to that Court"

Ga does not have a good child support enforcement dept. According to GA law, you can file child abandonment charges after a year of non payment of child support. I was told by ga child support enforcement to file chils abandonment charges on my own for non payment of child support.
