I have a house that I was selling and leased with option to buy with a six month lease option. The tenant has only paid 1 month of the 7 months of this lease. I have attempted to make contact with her by drive-by and phone and have not been able to collect the monies due me. What can I do to terminate this lease? Is there a way I can collect the 6 months due? The lease was signed by both husband and wife. The wife is still living in the house and has started divorce proceedings against her husband.

You would file to evict them BOTH according to the laws in your State. They are BOTH responsible for unpaid rent.

First you are not selling, you are renting. You should have 5 or 6 months ago starting eviction proceures
