    Theft under 5000 Sentencing guidelines.
    I have been charged with two counts of theft under 5000. I was a security guard at a high tech fortune 500 company. It is my frist time being charged with any offence. If convicted is there any way of avoiding a criminal record. A conditional discharge?

    Sorry... I don't know the details obviously but first offense if they have sufficient evidence; The most you can pray for is probation (Due to no previous Record). Be prepared for Fines for Probation supervision and court costs.
    Note: if you were under the influence at the time of the theft drug/alcohol testing could and most likely be a condition of your probation.

    We all make decisions we regret later. Don't feel bad just face this test honorably, get it over with and their will be plenty of life ahead of you to forget this ever happened.

    Normally on one charge they may do a diversion program but normally not with two. And the amount 4900 dollar or 5 dollars can make a difference

    A conditional discharge may be possible but depends on circumstances, like amount, circumstances, co-operation with police etc.. best to discuss with lawyer.
