    Custody of newborn / infant child
    My girlfriend and I were to be married in December.

    She is pregnant 4 months, changed her mind and has left to be with her mom in Washington state.

    Her reasons were for lack of emotional support. She has also been on anti depressants mosy of her life which she stopped taking during her pregnancy.

    I believe her mom has enabled her to leave for reasons of getting her daughter home after a lifetime of abandonment. She feels her mothers new invitation to now be a part of her life to be more important than raising our future child together.

    What are my rights to custody if she refuses to return?

    If she has moved away with your child, then you need to file for custody and visitation as soon as possible. If you wait a long time, the judge is going to wonder why you didn't want to see your child.

    As soon as your child is born you go to court and file for paternity and support. You won't be able to force her to move back to you though. You will be given visitation and you will be required to pay support.
