    Personal property contract
    I sold some of my furnishings to my tenant when he leased my home. Besides being behind on the rent he has not made any payments on the furnishings. I have a signed agreement of the sale. Do I go to small claims court to file for request for payment? Can I garnish their wages?

    Yes, you take them to small claims court. If you obtain a judgment in many places I believe that yes, you can have their wages garnished, but your local laws may vary. That would be a question you could ask at court. The first step is getting a judgment though.

    If you have a contract and they renege on the contract, then you can sue and obtain a judgement. That judgement may be used to garnish wages or attach bank accounts. It all depends on where you are.

    Its also possible that you may have to use different courts to sue of unpaid rent and the personal property.

    Generally, you would have to evict first before you sue for unpaid rent.
