    Florida law on eviction
    OK, I moved in to a property on the 1st January 2008 with a six month lease, the 6 month lease ended and I was never given a new lease to sign. My husband left me with two children and no job so I fell behind in rent.

    The management company that look after the property have spoke to my father and have said they they will be coming out today and asking me to move out immediately!!

    I have two small children and no money to move anywere else what rights do I have?

    If I do not leave the property how long does it take for an eviction to go through the courts?

    They cannot just tell you to leave. The first step is to give you a pay or vacate notice. This notice gives you 3-10 days to pay up or vacate. If you don't vacate by then, they will have to go to court for an eviction order. How long this takes depends on the local courts. Once they get the order, you will have a few days to vacate before the sheriff comes and physically removes you.

    You need to go after your ex for support and contact social services for help.
