Hello, I am 18 and I'm 3 and a half months pregnant. The baby's father is not with me. We dated for a year and 4 months and a month after I found out about the baby we broke up(because he hit me and busted my lip) He is now seeing someone else. He went to the last doctor visit, but he doesn't call to check on me or anything, he just calls around the date of the doctor visit. He has hit me before and has a drug problem, I thought he quit but I have found out he was doing drugs behind my back. Okay so now for my question, I was just going to give you a little history. I want to know if his rights are different if the baby has or don't have his lastname. And does it change if his name is on the birth certificate. Im very scared. I do not want my baby to be alone with him, with his past and his horrible temper and addictions. But He wants to have something to do with it. My father recently passed away and I know how precious daddys are and I want mine to have its daddy. But how can I make sure he can't come and get it and take it for the weekend. Or be alone with my baby. Please help. Any help will be appreciated sooo much:confused:

If you don't put his name on the birth certificate/give the baby your last name you will have sole custody/control over the child and the father would then have to take you to Court, be adjudicated to be the father (usually using DNA testing) and ask for custody/visitation. You would, in return, file for support.

You could also take him to Court and ask for support and sole custody and DNA would be done.

If you can prove his past, if it's on record, not just guessing, you would present the evidence to the Court and request supervised visitation only (visitation in the presence of a third party) or no visitation at all.

This is a legal thread, not a personal advice thread, but good that you got out when you did - a lot of women don't and then everybody, including the child, suffers. Be careful and keep him out of your life (also your baby's life). Keep yourself safe.
