    We want rent-free tenant to leave
    We are a church that offered a rent-free room to a college kid several years ago in exchange for security duties. He is now an adult with a college education but without a full-time job. There is no written contract or lease, money has never been exchanged. We've been asking him to leave for five months and he chooses to ignore our requests (verbal and written). How do we get rid of this guy? Any advice would be greatly appreciated.

    No problems at all.

    The fact that it's verbal and that he pays no rent are of no never mind.

    The sequence of events will be to issue him a notice of Non-Renewal.

    If he fails to leave, then you need to file a Notice to Vacate.

    If he still does not leave, then have your attorney file an eviction.

    People who own rental properties can do evictions themselves, but typically, when a company is the landlord, an attorney is required... so figure who will do it for you and get the proper forms from him.

    Yes, you will have to assume that there was a offer, an acceptance and an exchange of something of value,

    He has provided a security and you have provided a rental. This is a legal contract.

    since there appears to be no written lease or contract ( do that next time)
    you would be considered on a month to month basis.

    You have to give him a notice to terminate your agreement ( in writting) and a date to vacate ( get out)

    If he does not move out in that time frame, you will have to go to the court house and file an eviction with the court ( an attorney is great to help here)

    They will have a hearing, and issue an eviction. The sheriff dept will send someone out to watch as you move his belongings to the curb ( if still in the hosue) and you change the locks.
