It varies slightly from State and State and also by the age of the child.

In most States after a certain age (also varies by State) the child's preference will be heard but the child's preference does not mean that is the way custody will be awarded.

If custody is contested the Court will often appoint a legal guardian to evaluate the situation, interview the parties, make a recommendation to the Court.

How old are you and where do you live?

A CHILD doesn't get to choose. In some states a child's opinion will be heard, but the final decision is up to a judge. Different states have different rules about how much weight is given to the child's opinion.

In any case, the non-custodial parent (NCP) needs to file a petition for a change in custody with the court. As part of that petition your opinions will be heard. But if the NCP doesn't file for a change nothing will happen.

Why do you want to switch?
