    Full month's rent?
Hi- I have a question that I need answered. My husband and I live in NH and currently are not in a lease with our apartment. We found a new place to live and would like to move in Aug 19. We have given 30 days notice, and would like to partial pay the month of Aug- from aug 1-19. Our present landlord says that by law we have to pay the entire month of August. This is a problem though because the new landlord does not want to loose an entire months rent. Do we have to pay the entire month by law, or can we partial pay him Aug 1-19- and the new landlord the rest of the month? Hopefully this isn't to confusing. Please let me know. Thank you:)

The law does not require you to pay the full month of August unless the Lease dictates it... so it's a matter of his explanation that may be the issue.

When you say you are "not in a lease", did you not have a lease when you initially moved in? Never had a lease with this landlord?

If you are on a verbal month to month occupancy, then you're pretty much stuck with paying for the entire month of August unless you want to challenge it (which will cost you more time and money than it's worth) and risk credit damage over it.

I know it's a bit late to say so, but NEVER enter into a lease agreement without a Lease.

We were in a lease which ended in April. He put the place on the market I believe in MAy or so. He's a nice guy- I think he is just upset because he will be losing our income- plus the place next to us has been empty since dec. so I think he's just upset. We are going to try to work something out with the new landlord- I really don't want to eat almost 600$$.

The move-out notice terms will be what it says in the Lease, then. Does the lease specifically say that you are responsible for a full month's rent when you move out if you give notice mid-month?
