I have been awarded a judgment for past due medical bills. Extra school activities and baby sitting that my ex-husband is suppose to pay. But, why is my attorney having a hard time in getting the funds. This case has been now in court for almost one year. He is suppose to pay 100% of the medical bills and dental and half of all other expenses. Can any one tell me if I'm ever going to collect this money from him even though the parenting agreement states he suppose to pay and a judgement was placed against him.

Time for your attorney to haul him back before the Judge and have HIM explain why nothing has been paid. Other than that, there is nothing you can do.

Judgements are easy to get, getting the money is another thing, if your state does not allow garnishments it is even harder, if there is already garnishments up to a state max that is also a problem.

Not knowing more it is hard to say.

Thank you for your answers. My problem with the garnishment is he is self employed. He has put his company under his brothers name that is an illegal alien.

He has to work, if you show he has a home, a car, and so on, he will have to explain to the court where this money comes from, and if you prove he is lying, then the court will really go after him

I don't quite understand how a court could sign off on a judgement like your stating because both parents are suppose to contribute to the child's welfare but you said he's suppose to pay 100% medical and dental. Most courts I would think would throw that out.

That would be legal advice. Im not sure what part OP was referring to. When it comes to children BOTH parents are suppose to share equal responsibility. Unless the 100% was in reference to what was asked for in judgement. Otherwise it could be overturned for being unfair and biased to one side.
