    Legal or not to take child out of state on your wkend visitation?
    It it illegal to take your child out of state while you have them on weekend or holiday visitation?

    It would be illegal unless the custody/visitation order specifically states this. If it were for a weekend or holiday visitation and it was your turn for the visitation, then it would be perfectly legal.

    Ok, So No it does not mention anything about this in the order.
    And yes it would be on my weekend or holiday visitation.
    So it is definitaly LEGAL?

    Yes, most definitely. As long as you don't intend on moving out of state and this is just a vacation.

    Thank-you, that's is what I thought. My Fiancé did not believe me and I needed someone educated in this area to clearly say it so I could show him.(and rub it in his face that I was right! Lol) jk

    You need to be absolutely sure it says nothing about it. Most custody orders forbid it without notifying the other parent. And for all intents and purposes I would notify the other parent that your going to be crossing state lines with the child with intention to return on date specific. Cover your bases.
