    Chils support over 18
    My mom owes like 38,000 dollars in back child support to my dad and I'm 19 I really need it I'm homeless and have no where to stay I think I'm entilted to it I live in ga and my dad is in prison in la and he really don't need it so am I capable to receive it?

    My moms owes my dad and he's got two more years in lock up and my mom makes damn good money

    Oh I missed it was your mother that owes.
    I don't think you can take her to court for back child support but your dad should take it back to child support court asap. She is responsible to pay the back support.

    The question has been posted whether the child can receive the child support directly instead of the mother and the answers have varied.

    I don't think you can - it's money owed your father for your support, not your mother's debt to you.

    It would appear you are no longer in your father's house - because, of course, he's in prison - and so I believe you might be emancipated.

    You need to ask an Attorney these questions.
