    Married couples rental rights
I have a home in Polk County, Florida. My sister and her husband moved into it in April. There is no written lease and they have never paid me any money to live there. The utilities are in my name. The two of them are divorcing. He moved out, but still comes around and states he has legal right to be there until he is evicted.
Do I have a lanlord tenant relationship?
If I do how do I evict one with out the other?

You don't - legally evict them both. Both get ordered out. He leaves. She doesn't.

    Yes, you are the landlord.
