    Breaking a lease because of Court order
    I am a 40 yr old female that moved to Irvine Ca from riverside. I did this for a course that I was taking in OC and because I wanted my children to get a better education than they were getting in Riverside. After the move the courts decided that unless I moved back to Riverside, I would lose custody of my children. I had to move back as I was not going to lose my children. On top of this the company kept charging me every month a pet deposit and we didn't have a pet, and did not refund the money. My bill is going to be up to 10000 and I can't afford to pay this and I don't want my credit rating to go into the dump. I also took the steps 3 months before I left to ask the leasing agent if it would be OK if I moved back and broke my lease. He said it would not be a problem, they would rent it before we left. He left the company and didn't even tell anyone. Does anyone have advice for me? Am I going to have to pay the 140000 after all is said and done?

    Well the first thing is you never should have moved without first checking with the courts. The second thing is that the landlord can't double dip. Meaning you only owe up to when he rerents the unit. And he has to make a good faith effort to find a new tenant.

    So you need to know when a new tenant moves in. But you WILL owe the rent up to the new tenant starts paying.
