    Probation Violation (NEW YORK STATE)
    My fiancé was charged with reckless driving and the malicious endangerment of others. On top of this he already has a criminal record... and just happened to be on probation at the time of this accident. (This was his first probation violation) My question is... what will most likely happen now?

    I bailed him out a few weeks ago and had him admitted into a hospital for a psychiatric evaluation, about a month later I received a phone call telling me that the judge wanted him back in jail.

    My fiancé is currently in jail. He has had one court date and is now waiting for another one this week.

    What could possibly be taking so long? What will happen to him for a first time violation? Will he be facing a jail sentence for the remainder of his probation sentence... or will he most likely walk away with an extended sentence for his already pending case?

    Please help me I am confused... and (in a secret way) terribly scared for him. I have this nagging feeling that we are going to be separated for a long time.. .

    Hello M:

    There's no way to tell how much, if any, time he's going to get. Whatever time he MIGHT get, will be diminished if he has a GOOD lawyer representing him. I'd hire him one if I could.
