    J1 transfer to H1B
    Hi
    I am currently working in the US on a J1 visa for 18 months on an internship. It expires in Sept 09. I do not have to return to the UK for 2 yrs after the J1 expires

    My employer is keen to sponsor me for a H1B visa and we want to apply in 2009.

    What is the process if I am currently in the US on a J1, do I need to go back to the UK to apply for the H1B or can I do it from here?

    Any advice would be appreciated

    The problem is if you obtain H-1B, you will have to start in October 2009. If your J-1 expires in September, you must file change of status to other non-immigrant visa. Normally H-1B is consular processing, it's recommended that you should have your visa interview in your home country. Discuss this issue with the attorney who file your case on behalf of the employer.
