Can I have someone else's Social Security Disability payment garnished?
Social security is "protected income" and cannot be garnished.
In Ontario, where we practice, the protection afforded to such types of income also extends to the monies when they are in the debtor's bank account.
You can't garnish SSI, but you can freeze the bank account that it is deposited into. And as Judy pointed out, you need a judgment from the court before you can do this.
