    My roommate will not leave
    Me and my roommates lease has ended and I am not willing to renew it with her. I had to pay the full amount of rent on at least 5 occasions as well as utilities. The landlord is willing to let me take the whole apartment but now the roommate won't leave. She has been given a 60 notice and will not go. She actually told the land lord to take her to court on the 60th day when the landlord came to get the key. She has no employment and will not pay any rent. I can't renew with her and I don't want to move.


    What can I do? If a new lease is drawn can I myself change the locks or call the cops for her to go?

    This is in NY. I was told that it takes months to evict. She should be considered a squatter.

    I believe the termination time is more like 3 or 30 days so your landlord was more than generous. If the landlord can not change it to a lesser termination time then they will have to take your room mate to court. I don't know if it is legal to reissue a new notice with less time.
