    Im being forced to stay in a mortgage I don't want.
    Me and my ex partner have a joint mortgage together, I moved out of the property 3 weeks ago and there was talk of buying me out, now him and his family have decided that my name is stay on the mortgage whether I want it to or not. Which I don't, I just want to put the whole thing behind me and move on. We have a joint loan securred on the property and if it was to be sold now only a small profit would be made which is why his family won't sell and are looking to keep the property for at least another 5 or 6 years. There is no way that I want my name tied into this for another 5 or 6 years when we are no longer together and I no longer live there. What are my options and will I have to keep paying the mortgage for as long as they wish? Any advice would be greatly appreciated. Yours sincerely a most confused longsocks x

    You can take him to court to try to force a sale.

    Whose name is on the deed to the property - are you and your ex joint tenants?

    It is hard, the court may or may not force the sell, then of course if he does not want to sell, he may not show it good, keep it messy and more.

    Perhaps moving back in with two or three homeless people as guests may be fun.

    It is not their decision to have you on the mortgage or not. They are powerless to have your name removed. The lender WILL NOT ALLOW IT. The ONLY way to get your name off the mortgage would be for them to get their own mortgage on the property.

    RE: you paying the mortgage going forward... well... if you don't and they don't then everyone's credit gets trashed.

    I'd consult with an attorney on this one... BEFORE the next mortgage payment is due. I've seen people extorted into paying loans on homes they don't live in just to save their credit rating.
