Identity theft (is the bank liable?)
This is sort of a strange one. The summer of 2007 I found I was a victim of identity theft. I tried to open an account with Chase Bank and found that I had an account already opened up in my name by somebody who lived in New York. They had all my information (mother's maiden name/SSN/date of birth) so there was no mistaken that they were trying to be me. I have never banked with a bank before... only with credit unions so there is absolutely no chance I could have opened this account... also I live in Colorado. Anyway... I filed the necessary paperwork and did a temporary hold with the credit agencies. Chase ended up closing that account because it was identity theft. Again this same person struck... I received a hospital bill from New York... so in trying to prove to them that I was a vicitm of identity theft... I went to Chase Bank to get whatever information on the thief that I could... Come to find out that they (Chase Bank) had opened up a second bank account for this person... tand I know it is the same person because it matched the info from the last person... and he or she ended up withdrawing a ton of money from the ATM that he did not have so the bank charged the account off. This happened this past summer. Now I can see a bank or company allowing this to happen to me once... but it really blows me away that a person could commit identity theft on me twice with the same company... especially after they had my name flagged for identity theft. Are their laws protecting consumers from this sort of negligence? Does anybody think this is something I should try and sue Chase Bank for?
