    Illinois 5 day notice
    I am trying to start the eviction process for my tenants. The lease renewal month is the month they stopped paying rent. They currently do not have a lease and is 3 months behind. When I feel out a 5 day notice and they specify that the lease will be terminated on ________ date... What should I put since technically they do not have a lease?

    When a lease expires in Illinois, a "month to month" lease becomes valid for every month living in the residence beyond the yearly lease.

    Their lease expired on the first day of the first month they did not pay rent

    5 day notice
    I guess what I really meant to ask is how to properly fill out the 5 day notice. There is a line that state the tenants lease will terminate on __________ date. Since they do not technically have a written lease, should I leave that line blank or should I fill it in with the date that correspond to the 5 day notice? For example I gave the notice 11-26-08. After 12-3-08, if I have not received pymt I can go to court to file. Do I indicate that date on the notice?

    Yes. Fill in the date when the 5 day notice period ends. That is the date when their tenancy is terminated.
