Ask Me Help Desk - Dealer finance car without title

I don't know what to do. I purchased a 2005 chevy impala back in July 08. The bank that finance my car just telling me now in dec that the dealer never submitted my paper work to mva meaning he never paid the tags/title/registratin fee which would be 6%. On top of that I do have hard tags and a registration which is not even in the system for Maryland. So I did some back tracking and found out that the owner of the vehicle was in pennslyvania. But since the bank is the lien holder they can not release the title to me and it seems like the bank is taking its time when this car I have is register in pennslyvania not in Maryland the sad part the dealer went out of business now I'm making payments on a car that when I'm finshed they can't release the title because they don't have it. What should I do?

I'll answer a question with a question (and I've called in an expert) - how did you license and insure a car you don't own?

Ok, trouble is who actually owns the car, another person who traded it into the dealer, or the dealer.

And the bank is likely to call the loan due if they can not get the title.

I don't think you have the correct information here. The laws may be slightly different in your state, so I'm going to explain it as if it were in Wisconsin.

If the dealership never submitted your paperwork, you wouldn't have received a title, registration OR plates because the DMV never got any news that the car had a new owner. You can't possibly have registration for the vehicle if the paperwork wasn't submitted; you say you have registration which means something was submitted somewhere. I have no idea how you were able to find out that your vehicle wasn't in the "Maryland system" unless you were pulled over and told this by an officer of the law.

I also have never heard of a bank "holding" the title. They usually send documentation to the DMV and it automatically gets recorded on the title that there is a lien on said vehicle; they don't keep the title at the bank.

The original owner may be in PA, which is fine. The bank has no obligation whatsoever to provide a lien release unless the lien is first paid; have you ensured that the lien is paid? Have you contacted the original owner to request that they obtain the lien release and mail it to you? If the lien hasn't been paid off, then you can't register that car in your name, period. It doesn't matter if you're in Maryland, Pennsylvania or Timbuktu.

The bank I finance my car threw gave me a copy of the bill of sale. So should I take it to the dmv in Pennsylvania to see if they would give a copy of the title or should I wait for the bank to do what they have to do. To me it seems like they are taking there time and I'm riding around in a car that is not even register in Maryland. What should I? Thanks everybody for advice on pt.1.

First, please don't start new threads regarding the same topic. It gets confusing and clutters up the board.

Second, you haven't answered the questions that I posed in your first thread. You're not going to get an accurate answer unless you give us the full scenario.

And bill of sale does not get you a title, a properly signed old title gets you a title. The past owner will have to file for a lost title and sign it over to you to get a new title.
