On November 21ts I have gotten paid but my check was not singed and I called my boss they told me that me check would be over nighted to me so will have gotten in Monday or the next day those days passed and I still did not get my check I called Friday they told me the same story that they will over night it to me and ill get it Monday or the day affter and to this day I still have nit gotten my check and I have bills way over do can I take them to small claims court

Of course - but the jurisdiction in most cases is where the employer is located so you would have to go "there" in order to file.

Wage and Hour (or the equivalent in your State) can also handle this for you.
