My daughters father is not willing to be apart of her life. I have been taking care of her on my own since day one. I wanted to know if possible the biological father could turn over his rights to someone else. This person is willing to care for her by not only buying her what she needs but health insurance, life insurance, making sure she has food, clothing, and shelter. This person and myself are in a very positive relationship and will do for her even if our relationship doesn't work out. So basically I was wondering if the biological father could turn over his rights and have someone else take the responsibility.

You could try, if the new person is willing to adopt your daughter. What state are you in?

Have you been married to this new person for at least one year? If not then most states won't allow it in those states that you don't have to be married you have to be in a stable relationship for at least three years (if I remember correctly, I know it is much more than a year). If you have been married for at least one year then you can ask the bio dad if he would be willing to allow the adoption and if he says yes just hire a lawyer and it will be very simple. If he say's no then there is nothing you can do but take him back to court to have the support order enforced.

The only way the rights could be transferred is by adoption. The person wanting to adopt will need to consult an attorney to prepare the adoption petition. The attorney can explain what requirements the person adopting needs to fulfill.
