    Evict roommate

    I have the same as your top situation, I had evicted my roommate and file the complaint in the court, but she was win the case because she refused that I gave her 30 day notice, and judge decide to let she stay in my apartment and I am need to refile evict her again. I just wonder if I am not follow the legally by law, just throw her stuff out from my apartment, please give me an advise

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

    If you throw her stuff out, you will be violating the law and subject yourself to a law suit.

    Give her a new 30 day notice, make sure she acknowledges it or you have witnesses and it needs to be in writing.

    If she has not paid rent, then you can try a pay or quit notice.

    But if she doesn't move within the new 30 day deadline, then she will have no excuse, because you can show that the hearing was proof you wanted her out.
