Out of state company owes me money for services rendered- can I take them to court?
A temp-to-hire service found my resume on careerbuilders.com. They called me and asked me to work for one day administering vaccinations. I was promised in writing that I would receive $30/hour. I filled out and faxed the proper documentation needed to get paid. I was promised that my check would be mailed out three days later. It has been over two weeks and I have still not received my pay. I have called and emailed the company and they will not respond to me. I live in Minnesota and the company that hired me is based out of California. Can I file a small claims case against them or are there other avenues that I can pursue?

    Thank you.

    Hello a:

Yes, you can, and I would. It may not be that easy, however.

Assuming they're a corporation, they SHOULD have a local registered agent if they're doing business in Minnesota. That agent is listed, probably with your Secretary of State, or the Corporations Commission... I don't know what you call it there.

Once you find out who the local agent is, file a small claims suit against the company and serve HIM.

If they don't have anybody local to sue, and/or they're NOT a corporation, you're going to have to go to California to file suit..

However, California does have a pretty powerful labor commission, and you might get some relief there.

Also contact the company that hired them, you had to be working in some office or company, See if they have paid the firm. Since the work would have been done on their behalf, there may even be some liability there also
