When you run out of money to try and see your child, guess what? Your visitation rests in the hands of ex-spouse... So, basically I pay alot of money EVERY month for a child I don't get to see or hear from, and the child molester gets to live in the same house with him and play daddy with my hard earned money... Isn't life fair??????

Obviously you are very upset but you don't need money to enforce a Court Order involving custody/support - you go back to Court and file, requesting that your "ex" be held in contempt. The Courts are very user friendly in this scenario - you aren't getting a new Order. You are enforcing an existing Order.

While you're there you request a change in custody and/or visitation and bring your proof of the danger to your child. The Court will evaluate the situation, very possibly interview all of the parties, and make a decision concerning what is in the best interest of the child.

There is a sex offender registry in Missouri, on line, available to anyone who signs onto the site so I'm somewhat confused how a convicted offender who cannot live in certain areas can live with a child.

I am not clear on your issue here - is it that your child lives with a sex offender OR that your child "lives in the same house with him ... with your hard earned money."

The answer is: My son lives in the same house with a sex offender. My ex-wife now on husband number four, knowingly married a convicted sex offender. My son lives in the same house with him because he is now the his father. I have tried to get inforce the divorce decree on two occasions to get custody and the first attempt failed and I was ordered to pay both parties attorney fees. The second time the same thing happened and I also had an increase in child support.

When I found out that my child was living with a registered sex offender I hired another attorney and tried again, but it never made it to court because I ran out of money with the interviews, changes of venues, etc... This sex offender was also able to come and go from the school where my son went at the time. A school can only enforce what they know about, so other peoples children are still in danger from this man.

I am not writing this to have you write a divorce decree for me, nor to have sympathy. It is a fact that the person who has the child has the power! I have made every exhaused effort to have Child Protective Services do something... However, they only respond if a child comes forward or another adult on behalf of the child. In this situation, this is not going to happen, and if you knew what this man is capable of, then you would know why!

I am writing for the sole purpose of letting the public know that our laws are NOT protecting our children! I also know that either money or public outrage on certain issues are very strong factors in determining change... Since I am all out of money, then my only resource is to awareness to this issue, and hope other children don't fall into this same situation!

Thre is a sex registry in your State - if he's on it I don't understand why anyone can't understand why you don't want your son in the same house OR why the school is allowing him to wander around, unrestricted.

You say that this man is now your child's father but you also say you are paying support - was the child adopted by this man or not?

In NY you only have to pay costs on both sides if the motion is frivilous - I still don't understand why, with a criminal record and a public registry, "the authorities" are having problems with this. What am I missing?

I do have to wonder if there is more to this story. There are definitely instances where children do fall through the cracks. But the laws ARE there and, if properly used, they do protect children.

I am the biological Father to this child, however he resides in the house with a sex-offender. He is registered, but considered time served. He went to a mental hospital for a short time, but that was it. My ex-wife married this man, knowing that he had sexually assaulted his own biological 4yr. Old daughter, and a step-son age six at the time.

In my other forums, I go into all detail of the "whole story", but the quick version is that this man is not breaking any laws that are on the books in the state of Missouri. Yes, there are laws that prevent him from living under the same roof of children he has already assaulted, but different children is something that is not on the books.

It perfectly legal for this man to reside under the same roof with my son, and I am helpless, and moneyless, to try and fight this situation. I already went through an attorney and all the money was spent doing interviews, changes of venues, and everything else except court. I do not exercise my right to see this child because they keep him from me...

Here is an example: I ask for him 30 days in advance to have him for a holiday. I send the letter registered mail, and regular mail. I indicate that I need at least a weeks notice for my work and to prepare for the trip to Missouri, I live in Texas. I here NOTHING, so the week of the holiday I call my attorney and tell her the situation, and then I get permission to get him the day of the holiday... SO, guess who I don't get to see now? How much did this cost me? $375.00 in attorney fees... THIS IS HOW THE LAW WORKS!

SO, the registered sex offender gets my son every day of the year, and I get nothing, except the right to pay $400.00 a month, which allows the child molester to stay at home and not have to find a job outside of the home... The only thing missing from this story is that this man should not be allowed to reside in the home if he has had sexual relations with ANY children. This is how the law should read!

This is my frustration, and this is what will eventually destroy my son, because I have no idea if something is or has happened to him by now or not!! Try living with this day, after day, and night, after night... It will not only destroy my son, but me as well!

Once again - I don't see the entire problem to be this person's criminal/sex offender record. You keep quoting his history but it seems that the child's mother, your ex-wife, is the one legally keeping your son from you. This man may play a part in this but the situation is not legally under your control.

Whether he works or doesn't work is his choice and that of your "ex." I don't believe your $400 a month (which, by the way, is a joke in NY) supports your child AND this man. I pretty much spend close to that to feed two dogs.

This is also about your legal fees which are not the fault of this man.

I agree that if "he" is a risk it should be reported. Your son is 16 and I don't understand why he doesn't have a voice in this but it would appear you've exhausted all avenues. Is your son not allowed to telephone you?

How the law "should" read does not matter. It's all about how the law "does" read. If the Courts have decided that whatever happened was the result of some sort of mental illness or impairment and now he is cured, then that chapter is pretty much closed.
