    Tax Credit for 2007
    I am Indian Citizen and working on H1-B in Masshacussets, MA. I got married in Jan 2007 and my wife came to US on H4 in Feb 2008.

    I filled my 2007 Taxes as Single and did not claim wife as dependent as she was not in US. I was reading tax information in this forum and came to know that I should have claim my wife as dependent and could have save some tax money.

    Can I now claim Tax credit now for 2007? Or I missed it?

    Even for 2007 you can file joint tax return as residents. You must both declare your worldwide income. Now, you can file amended tax return Form 1040X. You will get a good amount of tax return.
    If your wife does not have SSN, you will attach W7 (ITIN application) with the tax return.

    Thanks. I don't have any income in India and my wife was a student then and she didn't either have income. What papers I need from India to showing NO INCOME?I don't even have PAN card from India.
    Can I file Amended Tax Return Form 1040X for 2007now or should wait and file it along with this year 2008 returns.

    You need show NO paperwork to show no income. All you need do is submit the Form 1040X and the ITIN application (Form W-7).

    You should do the 2007 amendment NOW, in 2008, with the Form W-7. If you mail it ealy next month, you will probably get the ITIN back before the end of the year and have it for the 2008 tax year.

    If you WAIT, you will run into the heavy volume of ITIN requests that the ITIN Processing Center gets every tax year, and the ITIN may take up to THREE MONTHS to be issued.

    One more question.. Should I use "Married Filiing Jointly" or claim her as "Dependent" as I got Stumulus Check rebate for 2007?

    Believe or not, the IRS says you can file Married Filing Separately, get the stimulus check, then go back and amend the return to file jointly without returning the stimulus check.

    So, file jointly when you amend your 2007 return to get maximum benefit.

    3. Revised 1040?

    Neither the W-2 nor the original Form 1040 should be attached. Those documents will only confuse matters.

    A revised Form 1040 can be attached, but is NOT required.
