This is my first offense and I am worried about lossing my job.
I was charged with theft under 5000 it is my first offense and I work in accounting and payroll I am dupposed to have a backgrond check tomorrow at my new job I just started and love but will the charge appear on my background check or is it when I am convinced that it will? Please help me as I said it is my first offense and the background check is tomorrow well actually in a few hours now I know I will have to be honest and tell my employer because I do deal with cash on a daily basis.

The charge may come up depending on how thorough a check the employer does. In the meantime, you'll just have to wait and see.

A normal background check only looks for convictions. Since no conviction has been entered it should be clean. However, employers can do more thorough checks that may turn up a pending case or an arrest.

So you just have to wait it out.

There is also the angle of the question, "Have you ever been arrested ..." which lately I see more frequently than "Have you ever been convicted ..."

You say, no, the background check today is clean; they run you again after a certain time frame and discover the arrest and you're out of a job for lying on the application.
