    House that I'm renting has been foreclosed on.
    I am renting a house I have a 1 year lease the house foreclosed on 10-25-08 and was scheduled for sale on the court hose steps on 11-21-08 I found out about it only hours before the sale I did call and find out the trustee postponed the sale until 1-22-09 and then called the landlord and he said I still have to pay him rent and the house is totally foreclosed on. Who do I know who to pay the rent to if there just going to kick us out!
    How do I get my deposit back? Should I get a lawyer.

    Your lease is binding on anybody who bought the building. However, it's NOT binding on a new owner due to foreclosure.

    Yes, technically you owe rent to your landlord until he's no longer your landlord. He's the guy you'd be getting your deposit back from, if he has it... Sooo, even though it's not legal to do so, I would use up my security as rent and then leave when that's up...

    If you stay until Jan 22, then you'll owe December and January's rent.

    Of course, you might have to leave earlier if the new owner goes to court right away at attempts to evict you.

    If the house doesn't sell on the court house steps, and it probably won't, the bank is going to be the new owner. They certainly might want you as a tenant - at least for the time being... Write or call them..

    If it DOES sell, maybe the new owner will STILL want you as a tenant.

    However, if'in it was me, I'd move and avoid the whole thing. You've got a little time.

    So what I'm worried about is that he is no longer the owner now because the house totally foreclosed on 10-25-08 and if I pay him he'll pocket it like he has been and I can't get it back and I will have no money to move .
    And I won't get the deposit back!

    If it WAS foreclosed, as in HE NO LONGER OWNS IT, you don't owe HIM rent. You owe the bank. If they're not hasselling you, then you're cool for the time being.

    No, you may not get your deposit back. Plus, he owes you the rent you overpaid him since 10-25. You could sue him for it, but good luck with that.
