    Of course you could go to jail depending upon the charges against you. Why would you think you wouldn't?

    Normally, there would need to be a warrant issued for the arrest of a person in order for them to go to jail, but not in all cases though. Also, whether a person spends an amount of time behind bars, beyond that of the usual booking procedure, can depend on a number of factors, like being able to and posting bail, agreements in court before a magistrate as to maybe someone being allowed to go free on their own recognizance and some other factors.

    This is a complicated issue though, where there isn't a cut and dried answer, and I'm sure that there will be others who'll come along to address your question.

    Is there a particular reason that you're asking about this, please?

    How someone presses charges vary from state to state, in some areas they will have to file a report to the DA, in others if the DA does not act, they can file their own complaint in court to prove there is enough evidence of a crime.

    But yes, if the crime is seroius enough you can go to jail if someone presses charges
