    Employer Refuses to Pay
I have made every effort to get my final paycheck from my former employer. They refuse to send it. My next step is small claims court. Can I sue for court costs?

Normally yes, you will have to ask the court where you plan on filing.

Why will they not give you the check ? What are they saying

As FrChuck says, Court costs are "normally" just awarded by the Court without even asking. Investigation and costs to prepare for the hearing are not reimbursable but are part of proving your case.

I contacted the Labor & Industry Division of the state I had been working in last. I had the check within a week or so.

I contacted L&I about mine. My dispute has been going on almost two months and I still haven't seen a dime.
