    Hello sir
    I have a j1 visa and my wife have a j2 visa. If we make a baby here we can stay here. Without home country 2 years rule.its possible,we can stay both or only one person. Give me a reply .

    Though your child obtains US citizenship by place of birth, but this does not mean that the parents, you and your wife, can legally stay in US without proper visa. You won't be able to obtain green card, etc. However, if the child grows up and meets the requirements to petition immigrant visas for the parents, he/she can do so. Basic rules are 21 years of age, with tax return of 3 years plus income of 125% of the poverty guidelines, no criminal records, etc.

    You won't be able to maintain your legal status for 21 years. All non-immigrant visas have certain limit terms and in many cases, you cannot file for extension more than twice. You would need to return to your home country.
