I would like to know how I go about getting my sons father for abandonment he hasn't had anything to do with my son in 11 years and never paid support I would like to get child support but I want to make sure he cannot see my son unless that is what my son wants to do so how do I go about this I live in Ohio help me please ?
What does the court ordered child support paper work say ? Have you turned him over to child support enforcement ?
Have you went to court for a garnishment of his pay for child support ?
Support and visits are not related, he will have to go to court to get his visits. But if he gets s court order for visits you may have to let him visit. But you could get supervised visits to start with
First, you cannot get your "sons father for abandonment". There is no such thing. Abandonment of a child means living a minor child totally unsupervised.
What do you think getting him for abandonment will accomplish even if you could do it?
Have you ever gone to court for child support?
As for visitation, you can file for support without visitation. If he wanted visitation he would have to petition for it. If he hasn't had any contact in 11 yrs, he would be hard pressed to justify it now. Also your son is old enough to express his preferences.
As noted you can't "get him for abandonemnt" I acually just answered another post on this same thing just a few seconds ago. Read around a little bit but bottom line is if you haven't gone to court for support then he owes nothing if you do have an order for support and he hasn't been paying then take him back to court. It's up to him to file for visitation not you so don't worry about that till it happens.
I have not went through child support for this I just want to and don't want him to be able to visit unless its my sons choice but I also have two girls and they're father pays support but has not even met the youngest and she is 4 so what can I do
The only thing you can do is go to court and file for support. He dosen't owe you anything unless you file. You don't file for visitation he would have to do that and then the judge would start it out slowly judges are smarter than some people give then credit for.
We told you what to do in previous responses. To repeat, you go to court anf file for child support. You deal with visitation, if and when he asks for it.
Well the point is that I do not want to go to court to give him the chance at visitation I have a friend that did get the father of her son for this and I guess I will just ask her how to go about it because honestly I am not sure you know what you are talking about I really don't like this person so I wanted to try another approach but I guess I wasn't explaining it right or something because no it did not help thanks for trying but no it did not help
If its not hellping its because you aren't listening. If you look through this forum, you will find several threads that say the same thing. The advice is accurate.
Again, you may be able to use abandonment to get something else, but you can't get him for abandonment.
What you need os to consult an attorney (not a friend) who can tell you what the law is in your area and what you can and can't do. You may be able to force him to pay support while denying him visitation. I can't say for certain without knowing more details.
But please don't say advice was not helpful just because you refuse to believe it.
When you get a chance could you let us know what state your " friend " is in because I can't find any statuates in OHIO law that define abandonment.Quote:

You say you want support but don't want to go to court. That is the only way to get a support order plain and simple.
