I was never married to my son's father and we have not been together for over a year. I am married now and my son's biological father leaves the state for weeks at a time and never send's anything back to help support him. I don't like it when my son goes to see him when he comes back to town (he stays with his mom when he comes back). My question is does my husband have more rights to my son since he suppports him and I was never married to his dad?

Support and visitation are two separate issues. Is he on your son's birth certifcate as the father? Do you have a court order for support? I don't necessarily think one has more "rights" so to speak. Perhaps you should check with an attorney.

Are you having issues with what happens when you son sees his father or do you just not like him being around him? If you have real issues with anything like safety for your son, then you need to take the legal route to rectify the problem.

No your husband has NO rights to your son what so ever, unless he has adopted him.
If the child's father is not paying support that is what child support orders are for, take him back to court to enforce it.

I apologize as I misread your original post. I was confused about him and his father and husband. I understood them to be one in the same.

So, let me clarify... what I meant was neither you nor your son's father have more rights over one or the other.
