    Considering the HIPPA Law: Do County Inmates have the same consideration as far as the HIPPA Law is concerned about PRIVACY AND CONFIDENTIALITY while seeing a doctor? I was concerned that they are not being given the same rights as others who see the doctor. I am concerned that they will be criticized by the other inmates. Some things are personal and need to remain that way.

    I believe HIPAA does cover inmates as well. The difference is that those eligible to be given medical history information may be expanded. For example, the warden and some guards may be required to know something about an inmates medical condition.

    But the principal of those people not being allowed to discuss the condition with anyone not authorized should be the same.

    I do understand your concern. However, inmates do give up a great deal of their right to privacy when they choose to commit a crime.

    Scott, These inmates are housed in the county jail and I understand that convicted people give up their rights and should but, these inmates have not been convicted of any crime, they have only been accused. It had to be embarrassing to say the least. My understanding is they are inoccent until proven gulit? It's such a shame that some people would rather violate a person's rights than to go by the HIPPA rules. Thanks I really appreciate your input.     Inmates lose many rights including some of the HIPPA, There will be guards present and hearing about their medical care.
    There will be often some code on their inmate housing cards on some certain illness.
    Inmates with certain illness may be taken to special housing, or even different prison if needed for their medcial needs, without asking inmate.

    Inmate medication may be delivered to the cell by a nurse and/or assistant. Other inmates may see them getting medication.

    We are talking prison, open showers ( inmates can see the others showing often) cells with bars have a toilet in the open and so on.

    May I ask what your interest is here? Were you one of those incarcerated or a relative of one.

    In any case, if you feel someone's rights have been violated, I would suggest going to your local ACLU office and talk to them. They may be interested in pursuing this.
