I live in Indiana, At the present time I have visitation set at 2 days a week. There is a modification hearing set for next week.
The mother wants to change it to 1 weekend a month. My son passed away last year, he had custody of my grandson till then. I was his caregiver for 3 1/2 years. He is 5 now.
Do you think 1 weekend a month is resonable? Or am I unresonable? The Gal, has never thought I should have visitation, and she is saying 1 weekend a month is all she will say when we go to court. The sad part is between all the past attorney fees, counsler, and funeral expenses I am now broke and cannot afford an attorney. Any help or advice would be great.
    Thanks

If you were primary caregiver, then 1 weekend a month is not reasonable In my opinion. Unfortuantely, I'm not the judge who will sit on your case. So I can't predict what a judge will do. Its possible, they will see a need to wean the child away since you are no longer the primary caregiver.

Honestly, I think her requesting only one weekend a month is crazy but again I'm not the one who makes that decision. I would build up your case as best you can as to why you want it continued as is and why you think it would be best for the child as well. The judge has to look out for the best interest of the child after all. I'm sorry for your loss and wish you the best if you have any more questions please ask and you'll get the best help we can give.
