    My husband and I are still married but separated have not been to court yet for anything and I want to leave the state with my child can I do this even if he tells me I can't take the child.

    Hello sea:

    Until there's a court ordered visitation agreement, your child is just as much yours as his, so, of course, you can leave the state.

    However, if he goes to court and gets visitation, the court might make you move back.

    My opinion would be that you forgo your life in the short term, so that your child can enjoy growing up with BOTH parents.
